• I fully understand that HYO Martial Arts, its staff members, and instructors are not physicians or medical practitioners of any kind.
• I hereby release HYO Martial Arts, its staff members, and instructors to render first aid in the event of any injury or illness and, if deemed necessary, to seek medical assistance, including transportation by staff or any representative of HYO Martial Arts—whether paid or volunteer—to any healthcare facility or hospital, or to call an ambulance should it be required.
• I/THE MINOR FULLY UNDERSTAND(S) that martial arts activities involve risks and dangers of SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH (“risk”).
• These risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the activity, the conditions in which the activity takes place, or the NEGLIGENCE OF THE “RELEASEES” named below.
• There may also be other risks and social or economic losses either not known to me or not readily foreseeable at this time.
• I/THE MINOR fully accept and assume all such risks and take full responsibility for any losses, costs, or damages incurred as a result of my participation in the activities.

• I/THE MINOR HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO HOLD HARMLESS HYO Martial Arts, any school or facility where activities take place, their directors, administrators, agents, officers, volunteers, employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of the premises (each considered one of the “RELEASEES”) from any and all liability, claims, demands, losses, or damages caused or alleged to be caused, in whole or in part, by the negligence of the Releasees or otherwise.
• I further agree that if I or anyone on behalf of the minor makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, liabilities, damages, or costs that may arise from such claims.

• I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I/THE MINOR HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT.
• I HAVE SIGNED IT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY KIND, AND INTEND THIS TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT PERMITTED BY LAW.
• SHOULD ANY PORTION OF THIS AGREEMENT BE FOUND INVALID, THE REMAINDER SHALL CONTINUE IN FULL FORCE AND EFFECT.

• I agree to abide by the rules and regulations of HYO Martial Arts at all times while on its premises or at any sanctioned martial arts event or exhibition.
• I understand that HYO Martial Arts is not responsible for any lost, stolen, or damaged personal property.

• HYO Martial Arts reserves the right, at its sole discretion, to terminate or suspend any student from participation for actions involving fighting, assault, physical violence, or violations of the law.

• HYO Martial Arts reserves the right to take and use photographs or videos of all students during classes and events for marketing and promotional purposes.

• I have read and agree to abide by all membership terms and conditions.

“BILLING DIRECT AUTHORIZATION”

1.Buyers agree to make monthly installment payments to HYO Martial Arts
2.The buyer requests the privilege of paying payments to HYO Martial Arts, under the conlpany’s pre-authorized payment plan, and hereby requests the company to draw items from (Check/Electronic Fund Transfer or Credit Card)

“SUBJECT TO THE FOLLOWING CONDITIONS”

1. The items shall be drawn on or about the date or dates ofthe membership agreement.
The transactions on your bank statement will constitute receipts for payment on your account.
2. The plan if cancelled, does not release the buyer’s obligation of membership agreement/contract.
3. A service charge of $15.00 will be applied to all insufficient drafts, checks, electronic fund transfers or charge cards.

Remarks:

I acknowledge and accept the risks associated with martial arts training and agree that all participation is voluntary and at my own risk.
HYO Martial Arts is not responsible for any injuries or accidents that may occur.

“CONSUMER RIGHT OF CANCELLATION”

• You may cancel this agreement penalty free within 3 days of execution date of this agreement, exclusive of holidays and weekends upon mailing or delivering written certifies notice of cancellation to above address.
• This agreement may be canceled for reasons of death or substantial disability by providing a death certificate or disability statement by a certified physician.
• You may cancel this agreement if the center goes out of business and fails to provide facilities within 10 miles, or moves its facilities more than 10 miles from the present facilities. Agreement may not exceed 60 months.
• For monthly payments, cancellation is allowed if notice is given at least three (3) days prior to the payment date.

“CANCELLATION FEE CALCULATION”

In the event that the agreement must be canceled for unavoidable reasons, any discounts previously applied will be revoked, and the membership will be recalculated based on the regular monthly fee OR blackbelt monthly fee.
The amount corresponding to the discounted portion will be charged, not to exceed a maximum of $500.
